THE HON'BLE DR JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.6005 OF 2017 ORDER:
Heard the learned counsel for the petitioners-accused Nos.1 and 2 and the learned Public Prosecutor for the State. Perused the record.
This Criminal Petition is filed to quash the proceedings in CC.No.172 of 2017 on the file of the Special Judge for Economic Offences-cum-VIII Additional Metropolitan Sessions Judge, Nampally, Hyderabad. Having argued for some time, learned counsel for the petitioners submitted that the second petitioner-A2 is aged person; if the second petitioner's personal appearance before the trial Court is dispensed with, that would be sufficient; and, as and when his appearance is required by the trial Court, he is ready to appear.
In view of the age of the second petitioner-A2, who is the Managing Director of company-accused No.1 and since the allegation against them is only of non-submission of cost audit report within stipulated time, the prayer of the petitioners can be considered.
In the result, on filing of an application to dispense with the personal appearance of the petitioners/accused Nos.1 and 2, the trial Court shall consider the same and the advocate holding special vakalat is permitted to represent the said petitioners/accused Nos.1 and 2.
With this direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending shall stand closed.
