THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY WRIT PETITION NO.8716 OF 2007 ORDER:

This writ petition is filed challenging the action of the respondents in not permitting the petitioner to appear for the interview to be held on 25.04.2007 in the office of the respondent No.2 for the post of Junior Lineman on contract basis alleging that the petitioner is eligible for being appointed as Junior Lineman on contract basis, but he was denied an opportunity of appearing for interview in terms of BP (P&GPER) Ms.No.36 and 37 dated 18.05.1997. Therefore, the action of the respondents is contrary to the guidelines issued by the Board and prayed to issue a direction to the respondents.

While admitting the writ petition on 24.04.2007, an interim direction was granted directing the respondents to receive the application of the petitioner and permit him to appear for the written examination scheduled to be held on 25.04.2007 for the post of Junior Lineman on contract basis. In terms of the interim direction given by this Court, application of the petitioner was received by the respondents, but his candidature was rejected on the ground that the petitioner was over-aged by the date of notification and therefore, the petitioner is not eligible for the post of Junior Lineman on contract basis. Therefore, the cause in this writ petition does not survive for any further adjudication.

MSM,J WP_8716_2007 Accordingly, the writ petition is dismissed. No order as to costs.

The miscellaneous petitions pending, if any, shall also stand closed.
