Heard Mr.P.Narahari Babu for petitioner and the learned Assistant Government Pleader (Assignment).

The circumstances are not in dispute and the dispute centres around the small area whether the petitioner can remove rock structure constructed to store rain water from the water shed funds in an extent of Ac.0-5 cents in Survey No.586-3 of B.G.Halli Village of Rolla Mandal or not.

The 4th respondent through written instructions dated 19.06.2018 informs that to the extent of Ac.0-66 cents, the respondents are not interfering with physical possession and enjoyment of petitioner of subject land, but the 4th respondent is insisting upon not to change the physical features or remove the bund. Mr.Narahari Babu submits that the possession is not interfered with on the physical features. The 4th respondent can issue appropriate directions and the same will be adhered to. The statement is placed on record.

The writ petition is disposed of by granting liberty to 4th respondent to communicate order directing the petitioner not to remove the rock structure (katta) existing in the petition land. No order as to costs.
