THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.6556 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos.2 & 3 in Crime No.687 of 2021 on the file of Hayathnagar Police Station, Rachakonda, registered for the offences punishable under Sections 363, 376(2)(n), 493 read with 109 of IPC & Sec.5 red with 6 of POCSO Act, 2012.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The allegation against these petitioners is that they have supported Accused No.1 who had eloped with the victim girl (LW3) and went to their resident at Bhadrachalam. According to the Remand Report, Accused Nos.1 to 3 went to Simhachalam temple of Visakhapatnam, Andhra Pradesh, where Accused No.1 married the girl in the presence of Accused Nos.2 and 3. Thereafter, these petitioners/A2 & A3

took them to Rajahamundry and arranged for a rented room where Accused No.1 and LW3 is staying.

As seen from the allegations these petitioners have taken A1 to the temple for the purpose of getting him married with LW3. Whether they had knowledge or not about the age of the LW3 is the question of trial. However, since the petitioners are in jail since 26.06.2022, these petitioners can be granted the relief of bail.

Accordingly, the Criminal is allowed and the petitioners/A2 & A3 are granted bail subject to the following conditions:

i) The petitioners/A2 & A3 shall execute personal bonds for a sum of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties for a like sum each to the satisfaction of XIV Additional Metropolitan Magistrate Court at Hayathnagar, Rangareddy District.

ii) The petitioners/A2 & A3 shall appear before the concerned Station House Officer on every first and third Mondays between 10.30 AM and 01.00 PM for a

period of three (03) months, for the purpose of investigation.

iii) The petitioners/A2 & A3 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed.
