THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.1249 of 2015 ORDER:

Upon hearing both sides, at the admission stage, the following Order is passed:

Having regard to the fact that Charge sheet is already filed and there is a prima facie case contained in the Charge sheet, it is not a fit case to quash the proceedings. Hence, the petitioner/Accused No.1 has to face the trial. However, considering the submission of the learned counsel for petitioner/Accused No.1 that the petitioner is aged 65 years even according to the Charge sheet and she is suffering with old age ailments and it is difficult for her to attend the Court on every adjournment, her appearance in C.C.No.388 of 2012 on the file of VIII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, is dispensed with except on the occasions when the trial Court requires her attendance.

Accordingly, the Criminal Petition is dismissed. As a sequel, miscellaneous petitions, if any, pending shall stand closed.
