Today, when the matter has been taken up for hearing, the learned counsel appearing for the appellant placed on record a copy of the common judgment passed in CEA. No.18 of 2006 and batch wherein the identical questions of law, which have been raised in the present appeal, have been considered and the appeals came to be dismissed as there was no substantial question of law to be considered in the appeal. The facts being identical and the questions being identical in the present appeal as well similar judgment passed in CEA. No.18 of 2006 and batch follows.

Accordingly, this appeal is dismissed.

As a sequel, miscellaneous petitions, if any, stands closed. There shall be no order as to costs.
