THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION NO.7566 OF 2015 ORDER:

The prayer sought in the Writ Petition is as under: " ....to Issue a Writ of Mandamus or any other appropriate writ declaring that the action of the respondents in proceeding to conduct of a joint survey of the sheds in G.L.R Sy.No.201 and 202, Thokatta Village, Secunderabad Cantonment for the purpose of disposal of the appeal filed by the petitioner before the 2nd respondent is arbitrary, illegal and without jurisdiction and direct the respondents to forbear from conducting any joint survey in respect of the sheds in Sy. No. 201 and 202 of Thokatta Village, Secunderabad Cantonment."

Respondent No.1 Board filed a counter affidavit. From the perusal of the said counter affidavit it is evident that the joint inspection as scheduled was conducted by the staff of respondent No.1 in the presence of the petitioner and his counsel Sri Nirmal Kumar and P.V.Sanjeeva Murthy etc., Even though the petitioner was personally present and participated in the joint inspection and survey, he refused to sign the work sheet. To substantiate that the petitioner along with his counsel was present in the joint inspection and survey, the photographs have been filed along with the counter affidavit.

Since the prayer sought in the Writ Petition is to declare the action of the respondents in proceeding to conduct a Joint Survey of sheds in G.L.R. Sy.Nos. 201 and 202 situated at Thokatta village, Secunderabad Cantonment and as the joint survey has already been conducted, this Court is of the opinion that no further cause would survive in the Writ Petition.

Accordingly, the Writ Petition is closed.

It is needless to observe that if the petitioner is aggrieved by the said joint survey conducted by the authority, it is open for him to pursue the remedies available to him as per law. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
