HONOURABLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION No.23438 OF 2019 ORDER:

The relief sought in this writ petition is to declare the action of the 5th respondent - Station House Officer, Rayaparthi Police Station, Warangal District, in interfering with the civil dispute despite ad interim injunction order in their favour vide I.A. No.386 of 2013 in O.S. No.163 of 2013 dated 02.12.2013 passed by the learned Senior civil Judge, Mahabubabad.

2. Heard Sri Venkat Reddy Donthi Reddy, learned counsel for the petitioners, and learned Assistant Government Pleader for Home and perused the material on record.

3. It is submitted by the learned counsel for the petitioners that the ad interim injunction order is still subsisting and in force.

4. The learned Assistant Government Pleader for Home, on written instructions dated 28.10.2019, submits that the petitioners gave a complaint to the 5th respondent on 09.08.2019 stating that petitioner No.1 viz., Gandam Jampaiah is owner of the land admeasuring 488 square yards in Survey No.6 of Rayaparthi Village and Mandal of Warangal District and one Bandari Srinivas and others removed the fencing and boundary stones of the same and are threatening and trying to dispossess him from the said property. He submits that on the basis of the said complaint, an entry was made in the General Diary, enquired into and during such enquiry, the

5th respondent addressed a letter to the Panchayat Secretary, Gram Panchayat of Rayaparthi Village on 14.08.2019 to provide information about the subject property and the report furnished by the Panchayat Secretary discloses that petitioner No.1 viz., Gandam Jampaiah is owner of the subject property. He further submits that after receipt of the said report and causing further enquiry in the complaint given by the petitioners, the police never interfered with the peaceful possession and enjoyment of the petitioners over the subject property.

5. In view of the aforestated submission of the learned Assistant Government Pleader for Home, nothing remains in this writ petition and, therefore, recording the said submission, the Writ Petition is closed. No order as to costs.

As a sequel thereto, Miscellaneous Petitions, if any, pending in the writ petition stand closed.
