The Hon'ble Sri Justice U.Durga Prasad Rao Writ Petition No.1494 of 2017 Order:

Heard Sri M.Venkat Ram Reddy, learned Counsel for the petitioner, and Sri Boya Ravinder Reddy, learned Assistant Government Pleader for Revenue (TS) representing the respondents. With their consent, this Writ Petition is disposed of at the admission stage.

This Writ Petition is filed by the petitioner challenging Notice No.C/634/2016, dated 07-01-2017, issued by the third respondent to show cause why he should not be evicted from the subject land.

When the matter came up for hearing, the learned Counsel for the petitioner would submit that earlier the present petitioner has filed WP.No.43321 of 2016 against the present respondents and others wherein this Court, while ordering notice to the respondents, gave a direction that the respondent- authorities shall not interfere with the constructions, if any, going on in the land in dispute except in accordance with law and adjourned the Writ Petition for two weeks. While the matter stood thus, the learned Counsel

UDPR, J WP.No.1494 of 2017 would further submit, the impugned notice, dated 07-012017, was issued by the third respondent to the petitioner calling for his explanation by giving time till 16.01.2017 only, which is not sufficient for him in view of the impending Pongal festival and therefore, the respondents may be directed not to initiate any action till 30-01-2017, by which time the petitioner would be able to submit his explanation. The learned Assistant Government Pleader, while reporting no objection for extending time, however, submitted that the petitioner may undertake not to proceed with the constructions in the disputed land till he submits his explanation.

In view of the respective submissions of the learned Counsel for the parties, this Writ Petition is disposed of with the direction that the petitioner shall submit his explanation to the show cause notice bearing No.C/634/2016, dated 07.01.2017, issued by the third respondent on or before 30.01.2017. Till that time, the respondents shall not take any action pursuant to the impugned notice and the petitioner shall not proceed with any constructions in the disputed land. There shall be no order as to costs.

UDPR, J WP.No.1494 of 2017 As a sequel to disposal of the Writ Petition, WPMP.No.1702 of 2017, filed by the petitioner for interim relief, is disposed of as infructuous.
