THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 18668 of 2015 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for the respondents.
2. The petitioner was appointed as a Fair Price Shop Dealer of Shop No.18 of Paludevarlapadu Village, Muppalla Mandal, Guntur District. The authorization is valid as on today. When the petitioner was not supplied with the essential commodities, he filed W.P.No.4473 of 2015 and this Court passed an interim order on 26.02.2015 in W.P.M.P.No.5926 of 2015 directing the respondents to supply the essential commodities to the petitioner so long as his authorization is valid and in force. While so, after receipt of the said order, the 2nd respondent issued a show cause notice dated 22.05.2015 framing four charges against the petitioner. Challenging the same, the present writ petition is filed.
3. I have perused the charges levelled against the petitioner and though charge Nos.1, 2 and 4 are minor, charge No.3 is serious. In the circumstances, this Court is not inclined to go into the veracity or propriety of the charges. Now, it is submitted by the learned counsel for the petitioner that the petitioner has already submitted his explanation to the show cause notice dated 22.05.2015.
4. In the circumstances, the 2nd respondent is directed to consider the explanation submitted by the petitioner, conduct an enquiry and pass appropriate orders, in accordance with law, within a period of 30 days from the date of receipt of a copy of the order.
5. The Writ Petition is accordingly disposed of. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. There shall be no order as to costs.
