This writ petition is filed to declare the action of the 3rd respondent-Station House Officer (SHO) in interfering with the petitioner's peaceful possession and enjoyment of the land in Sy.No.54 to an extent of Ac.3-00 cents of S.Mallapuram Village, Kundurpi Mandal, Anantapuramu district as illegal and arbitrary.
Learned Assistant Government Pleader for Home produced written instructions stating that after injunction is granted in his favour in I.A.No.511 of 2012 in O.S.No.148 of 2012, the 5th respondent filed application before the 4th respondent-Tahsildar to implement the orders of the Court below. Thereafter, the 4th respondent requested the 3rd respondent-SHO to provide police protection to the 5th respondent. No police protection is granted to the 5th respondent and the 3rd respondent is no way concerned with the issue, as it is civil in nature. More so, when the matter is in the civil Court, it is for the civil Court to consider the same and the 4th respondent has no business to deal with the civil issue.
In view of the same, the respondent-authorities are directed not to interfere with the civil disputes as alleged by the petitioner. But this order will not prevent the police from investigating into any offence.
With the above observations, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 19-06-2018 Nvl
