THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CIVIL MISCELLANEOUS APPEAL No.373 OF 2016 JUDGMENT:

This civil miscellaneous appeal is filed under Order XLIII Rule 1 of CPC challenging the order dated 14.3.2016 in I.A. No.23 of 2015 in A.S. No.12 of 2015 on the file of the Court of VII Additional District Judge, Gudur.

At the time of hearing, learned counsel for both the parties, in one voice, submitted that the appellate court may be directed to dispose of the appeal as early as possible.

In view of the submission made by the learned counsel for both the parties, the learned VII Additional District Judge, Gudur is hereby directed to dispose of A.S. No.12 of 2015 as expeditiously as possible preferably within a period of two months from the date of receipt of a copy of this order.

A perusal of the record reveals that there was an injunction order in favour of the appellant herein till disposal of the suit. Pending C.M.A., also, there is an interim injunction in favour of the appellant. Therefore, the interim injunction in favour of the appellant herein shall continue till disposal of A.S. No.12 of 2015. 5.

With the above directions, the civil miscellaneous appeal is disposed of. Miscellaneous petitions, if any pending in this miscellaneous appeal, shall stand closed.
