HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.187 of 2016 ORDER:

This petition is filed by the petitioner - Accused seeking to modify the conditions imposed by the III Additional Metropolitan Sessions Judge, Hyderabad in Crl.M.P.No.1580 of 2010 in Crime No.308 of 2009 vide order dated 7.6.2010, and to direct the IV Additional Chief Metropolitan Magistrate, Hyderabad for return of the passport of the petitioner and to permit the petitioner to leave India. Heard and perused the material available on record. Considering the facts and circumstances of the case, the condition imposed by the learned Additional Metropolitan Sessions Judge, Hyderabad that the petitioner shall deposit his passport is hereby relaxed.

The learned IV Additional Chief Metropolitan Magistrate, Hyderabad is directed to return the passport of the petitioner on his executing a personal bond for a sum of Rs.1,00,000/- (Rupees One lakh only) with one surety for the like sum. The petitioner is directed to produce his passport as and when required by the Court below.
