HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL REVISION CASE No.491 of 2017 ORDER:
Heard both sides.
2) The impugned order dated 04.02.2017 passed in Crl.M.P. No.45 of 2017 in C.C. No.613 of 2009 passed by the learned V Additional Metropolitan Sessions Judge (Mahila Court) Hyderabad, granted one month to surrender the passport before the Court, which is expiring by 05.03.2017.
3) In the facts and circumstances of the case, the time granted by the lower Court is extended for two more months i.e., till 05.05.2017. Further, instead of personal bond executed with two sureties, cash of Rs.1,00,000/ - (Rupees one lakh only) to be deposited to avail further two months time. If the petitioner failed to return the passport on or before 05.05.2017, the said amount of Rs.1,00,000/ - to be forfeited as penalty by invoking Section 53 IPC by the lower Court besides taking further recourse to secure by impounding the passport.
4) Accordingly and in the result, the Criminal Revision Case is disposed of.
5) As a sequel, miscellaneous petitions if any pending shall stand closed.
