THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CIVIL REVISION PETITION No.3370 of 2018 ORDER:

Aggrieved by the Docket Order dated 05.06.2018 passed in E.P.No.1 of 2017 in O.S.No.107 of 2016 by the Learned Junior Civil Judge, Rayadurg, the present Civil Revision Petition is filed. Heard the learned counsel for the petitioner. A perusal of the record discloses that the Notice was served on the respondent-Dhr., on 05.07.2018, however, he was neither present in person nor filed any vakalath. The trial Court has issued arrest warrant against the Jdr., on 05.06.2018. As the E.A.No.152 of 2017 in E.P.No.1 of 2017 in O.S.No.107 of 2016 is pending and considering the fact that the petitioner has complied the conditional order, dated 15.06.2018, passed by this Court, by depositing an amount of Rs.40,000/-, the impugned order, dated 05.06.

2018, passed by the learned Junior Civil Judge, Rayadurg, is set aside, giving liberty to the respondent to take appropriate steps subject to the orders that may be passed in the pending Interlocutory Applications before the trial Court. Accordingly, the Civil Revision Petition is allowed. No costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
