HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 1788 of 2005 ORDER: (per the Hon'ble Sri Justice S.V.Bhatt) The petitioner challenges G.O.Rt.No.73 Irrigation & C.A.D.
(PW.Maj.Irr.VII) Department, dated 29.01.2005. The operative portion of the impugned G.O.Rt. reads as under:
"In the circumstances reported by the Superintending Engineer, Irrigation Circle, Vijayawada in the reference 2nd read above, Government after careful examination in the matter hereby extend the lease for a period of 10 years from the date of issue of this order subject to withdrawal of W.P. and beyond the 10 metre belt from the toe of the Eluru Canal."
This Court through order, dated 07.02.2005, granted interim suspension and also restrained respondent Nos.4 to 7 from taking any steps in changing the nature of the subject matter of the writ petition. The period for which lease was extended expired by 28.01.2015.
Having regard to the above circumstances, the writ petition is disposed of by making the interim order as final order and further that effective cause does not survive for decision.
Consequently, miscellaneous petitions, if any, also stand disposed of. There shall be no order as to costs.
