K. Prasanna v. The State Of Telangana
THE HONOURABLE SRI JUSTICE P.NAVEEN RAO W.P.No. 23400 of 2019 ORDER :
This writ petition is filed under Article 226 of the Constitution of India, seeking the following relief:
"To issue a writ, order or direction more particularly in the nature of Writ of Mandamus declaring the inaction of the Respondents 2 to 4 herein in considering the Petitioner objection petition dated 3.6.2019, 11.9.2019 and 21.1.2019 respectively in respect of all that agriculture land admeasuring Ac.3-00 gts in Sy.No.362 and Ac.1-04 gts in Sy.No.363 of Thumukunta Village, Shamirpet Mandal, Rnga Reddy District as arbitrary, illegal and unconstitutional and consequently direct the Respondent Nos2 to 4 to consider the Petitioner objection petitions dated 3.6.2019, 11.9.19 and 21.1.19 in respect of the above said property". 2.
Learned counsel for petitioner filed Memo bearing USR No.71299/99 enclosing copy of Endorsement dated 14.11.2019, which reads as under:
"Sub:
Lands - Medchal-Malkajgiri district - Keesara DivisionShamirpet mandal - Report called for - submittedRegarding. Ref: (1) A/o K.Prasanna W/o K.Mahipalreddy dated 30.10.2019.
(2) Report of the Village Revenue Officer, Thumukunta village dated 2.11.2019.
I invite attention vide subject and reference cited, wherein K.Prasanna W/o Mahipalreddy R/o Hayathnagar (V&M), Rangareddy district has requested for issue of latest pahani in Sy.Nos.362, 363 of Thumukunta village and the same petition is forwarded to VRO, Thumukunta village for enquiry and submit report.
Further the Village Revenue Officer, Thumukunta village had reported that on ground said land is covered with Function Hall and in record 362/A1/2 (extent Ac.1-00 gts), 362/A1/1/2 (extent Ac.2-00 Gts) and 363/A1/2 (Extent Ac.1-04 Gts)
recorded Mogulla Srinivas Reddy S/o Mohanreddy as Pattadar and possessor.
Further on verification of office records one person Katepally Madhumohan Reddy S/o Janardhan Reddy had applied for mutation with File Nos.B/3767/2018 and B/541/2019 vide Registered Document Nos.6194/2018 and 6195/2018 dated 31.7.2018 SRO Shamirpet in Sy.Nos.
362/A1/1/2 (Extent Ac.0-36 Gts), 363/A1/2 (Extent Ac.0-04 Gts) and 363/A1/2 (Extent Ac.1-00 Gts), but both the files were stopped.
Hence this is endorsed".

Learned counsel for petitioner submits that in view of the said endorsement, the cause in the writ petition does not survive as of now.

In view of the same, the writ petition is dismissed, leaving it open to the petitioner to work out her remedies as and when cause of action arise. As a sequel, the miscellaneous petitions, if any, shall stand closed.
