Heard Sri K.Lakshman, learned counsel appearing for the petitioner and the learned Standing Counsel for TSRTC-respondent No.2.

2. This writ petition is filed questioning the action of the 2nd respondent-Corporation in not considering the application dated 226-2015 submitted by the petitioner seeking compassionate appointment as driver under Bread Winner Scheme. The petitioner's father late D.Srinivasulu worked as Helper in the 2nd respondentCorporation at Zaheerabad Depot, Medak district. He was retired on medical grounds on 26-10-2004 and expired on 22-3-2008 due to paralysis leaving the petitioner, his mother and his younger brother as his legal heirs. The petitioner studied up to X Class and he has Heavy Vehicle Driving Licence. He submits that he has experience in driving the heavy vehicles from 2010 onwards and therefore eligible for the post of driver under the Bread Winner Scheme.

The 2nd respondent-Corporation issued a Notification dated 10-02-2015 restoring the Bread Winner Scheme as a measure of redressal of grievances as one time measure. In the said Notification, it is decided to invite applications from the dependants of the deceased employees afresh who died while in service during the ban period i.e. 01-01-1998 to 04-01-2013 as one time measure.

3. It is further submitted that the petitioner has been requesting the 2nd respondent-Corporation to consider his case under the Bread Winner Scheme and on the advice of the 2nd respondentCorporation, the petitioner's mother submitted a representation dated

24-3-2012 to the Regional Manager, APSRTC, Medak Division, Sangareddy to provide compassionate appointment to the petitioner and to save their family. There was no response from the 2nd respondent-Corporation.

Thereafter, the petitioner sent a representation dated 22-62015 to the 2nd respondent-Corporation and requested to provide employment as driver under the Bread Winner Scheme pursuant to the Notification dated 10-02-2015. Inspite of the same, no action was taken on the representation submitted to the 2nd respondentCorporation.

Having gone through the contents of the Affidavit filed in support of the writ petition and on hearing both the learned counsel, the writ petition is disposed of directing the respondents to consider the representation dated 22-6-2015 submitted by the petitioner and pass appropriate orders thereon having due regard to the eligibility of the petitioner for the post of driver under the Bread Winner Scheme in the 2nd respondent-Corporation within a period of 8 (eight) weeks from the date of receipt of a copy of this order. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs. ___________________ R.KANTHA RAO, J.
