THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.6583 OF 2022 ORDER:

This Criminal Petitions is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/A1 to A4 in connection with COR.No.114/2022 of Prohibition & Excise Police Station, Bhadrachalam District, for the offences punishable under Section 8(c) R/w.20(b)(ii)(c) of the NDPS Act.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case against the petitioners is that they were found in possession of 40 Kgs of Ganja by the Excise Inspector, Kottagudem. The said contraband was seized in the vehicle in which petitioners were travelling. The petitioners were remanded on 08.05.2022 and are in jail since then. The investigation is complete and chargesheet is also filed pending committal.

In the said circumstances, these petitioners from whom the contraband is seized and languishing in jail, can be granted the relief of regular bail subject to following conditions.

i) The petitioners/A1 to A4 shall execute personal bonds for a sum of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties for a like sum each to the satisfaction of Judicial First Class Magistrate at Bhadrachalam. ii) The petitioners/A1 to A4, after release shall appear before the concerned Court on every date of hearing, without fail. iii) The petitioners/A1 to A4 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. 5.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed. _________________ K.SURENDER, J Date: 21.09.2022 tk
