Order:

This Contempt Case is filed alleging willful disobedience of Order, dated 24-12-2014, in WP.No.16422 of 2012, by the respondents.

At the hearing, it has come out that against the decision taken by respondent No.2 rejecting the occupancy certificate, respondent No.6 has filed WP.No.24217 of 2015; that the petitioners have also filed WP.No.21955 of 2015 seeking enforcement of the order of rejection; and that in WPMP.Nos.31433 and 28270 of 2015 filed by either parties in the respective Writ Petitions, a detailed interim order was granted by this Court on 07-08-2015.

Inasmuch as the order of rejection of

occupancy certificate by respondent No.2 is the subject matter of the above-mentioned two Writ Petitions, wherein an appropriate interim order was passed, this Contempt Case cannot be proceeded against respondent Nos.1, 3 and 5 at this stage. The right of the petitioners to enforce the rejection order depends upon the outcome of the above-mentioned two Writ Petitions.

In this view of the matter, this Contempt Case is closed with liberty to the petitioners to pursue the pending Writ Petitions.

As a sequel to closure of the Contempt Case, Application No.309 of 2015 is disposed of as infructuous.
