THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.6584 OF 2022 ORDER:
This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/A3 in Crime No.132 of 2022 on the file of VI Town Police Statio, Nizamabad, registered for the offences punishable under Section 307 read with 34 of Indian Penal Code.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that the petitioner/A3 is alleged to be a person who had attacked the victim along with A1 and A2 and caused injuries, for which reason, the police registered the case of attempting to murder.

Learned Counsel for the petitioner submits that there are no specific overtacts attributed to this petitioner and further the victim was discharged from the Osmania General Hospital on the very next date.

The fact of the victim being discharged from Osmania Hospital is not disputed by the learned Assistant Public Prosecutor.

In the said circumstances, this petitioner can be granted bail subject to the following conditions:
i) The petitioner/A3 shall execute personal bonds for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of II Additional Judicial First Class Magistrate at Nizamabad (Remand Court).
ii) The petitioner/A3 shall appear before the concerned Station House Officer every Monday between 10.00 a.m. to 1.00 p.m., for a period of three months or till filing of charge sheet whichever is earlier, for the purpose of investigation.
iii) The petitioner/A3 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed.
