Petitioner was appointed as Junior Assistant on compassionate grounds and subsequently promoted as Senior Assistant and thereafter Superintendent. He is presently discharging his duties as Assistant Commissioner on Full Additional Charge. According to petitioner, he is eligible for promotion as Assistant Commissioner. His grievance is that he is not considered for promotion and some others are promoted. On 30.05.2018, he made a representation praying to grant promotion by including him in the panal of eligible employees for promotion. Alleging inaction on the said representation, this Writ Petition is filed.

Learned counsel for the petitioner would submit that the petitioner is due for retirement in February, 2019 and if he is not granted promotion, grave prejudice would be caused to him. 4.

As noted above, the representation was stated to have been made only on 30.05.2018 and the same was addressed to the Commissioner and there is no proof of submission of such representation and acknowledgement of the office of the Commissioner, except some signature on the left side without any stamp. Be that as it may, even if the representation is made by the petitioner, he cannot expect the respondents to act on the

said representation with such a speed and allege inaction to rush to this Court within few days thereafter. 5.

The Writ Petition is accordingly dismissed leaving it is open to the petitioner to work out his remedies regarding his claim for promotion. There shall be no order as to costs.
