- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.13725 of 2011 ORDER :

Petitioners grievance was that they were ignored promotion as Sanitary Inspectors and therefore, they challenge the notification dated 07.04.2011 as contrary to the Rule 9 (1) of T.T.D.Employees Service Rules, 1989.

Learned Standing counsel representing the T.T.D., produced proceedings dated 28.09.2012 granting promotion to the petitioners to the post of Sanitary Inspectors. He would therefore, submit that the grievance of the petitioners is already conceded by the respondent-Devasthanam and promotions were granted. Therefore, the cause in the writ petition does not survive. 3.

Learned counsel for the petitioners would only submit that the order granting promotion would say that it is subject to result of the writ petition and they may withdraw the promotions granted after the writ petition is disposed of.

Learned Standing counsel, on instructions, would submit that subject to fulfillment of other conditions, the promotions granted to petitioners would not be disturbed merely because the writ petition is disposed of.

Having regard to the same, the writ petition is disposed of as having become infructuous as a consequent to the promotion granted to the petitioners vide proceedings dated 28.09.2012, There shall be no order as to costs.
