THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.20280 of 2016 ORDER:

Questioning the inaction on the part of respondents 1 to 5 in considering the representation, dated 20.06.2016, submitted by the petitioners, complaining interference with their property by the private respondents 6 to 10, this Writ Petition is filed. The petitioners submitted the said representation to respondents 1 to 5, seeking the following relief:

1) Forthwith initiate immediate appropriate criminal action against all the concerned police officers referred to above by names and also the Sarpanch of Samireddipalli Village Sri V.Yogananda Chowdary and also the Panchayat Secretary of Samireddipalli Grampanchayat, by registering a criminal case and prosecuting them for all the offence of trespass, cruelty, destruction to the property and the threats to the life made against Smt. V. Bangaramma.

2) To pass immediate orders granting police protection to us because now we are living 24 x 7 under the threat of their lives with serious imminent danger to their lives, family members lives and also their properties.

3) To forthwith initiate appropriate action and ensure that there is no interference in our peaceful possession and enjoyment of our land admeasuring Ac.0-48 cents in Sy.No.191/44B in Jettigundlapalli, Ugranapalli P.O., Penumur Mandal, Chittoor District.

4) To take immediate action against:

a) The Samireddipally Grampanchayat Rep. by its Panchayat Secretary, Samireddipally Village, Ugaranapalli P.O., Penumur Mandal, Chittoor District, Andhra Pradesh.

b) V. Yogananda Chowdary @ V. Ramachandra Naidu, S/o V. Bhaskar Naidu, Hindu, Aged about 65 years, Occ: Sarpanch, R/o Samireddipally Village, Ugaranapalli P.O.,Penumur Mandal, Chittoor District-517126.

A perusal of the complaint itself discloses that essentially, the petitioners are alleging attempt to trespass into their property

against the private respondents. Inasmuch as, it is in relation to the land, petitioners are at liberty to approach the Civil Court and obtain the appropriate suitable injunctive orders against the private respondents.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, pending if any, shall stand closed. _____________________________ CHALLA KODANDA RAM, J.
