THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.30912 OF 2017 ORDER:

Petitioners claim that they are the owners of land to an extent of 1000 bigas in Survey Nos.227, 282, 231,233, 241, 242, 268, 281, 282, 283, 284, 285, 290 and 294 situated at Abdullapurmet Village and Mandal, Ranga Reddy District. Petitioners apprehend that some third parties may present documents before the sixth respondent-Sub Registrar in connection with sale of properties belonging to the petitioners mentioned in the above survey numbers and no such documents should be entertained by the Sub-Registrar. It is further contended that an objection petition was submitted on 28.08.2017 and the Sub-Registrar should take note of the said objection petition.

The registering authority is bound by the Andhra Pradesh Registration Act, 1908 and the Rules made thereunder. Neither under the Registration Act nor the Rules made thereunder, there is a provision incorporated which enables a person to file complaint in advance in the form of caveat against entertaining of a document for registration. Further, there is no provision for consideration of objections filed even before a document is presented for registration. More over, the averments of the petitioners and the petitioners' apprehension that some third parties are likely to present the documents for registration are also vague. The scope of consideration of objections is limited to the parameters laid down under Rule 58 of the Registration Rules.

Having regard to the statutory provisions, the prayer sought in the Writ Petition cannot be granted. The Writ Petition is liable to be dismissed and is, accordingly, dismissed leaving it open to the petitioners to avail the remedies as available in law, if they have any grievance of illegal alienation of the properties which the petitioners claim to be belonging to them. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand dismissed.
