THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.39058 of 2013 ORDER:

There is no representation on behalf of the petitioner. 2.

The prayer sought in the writ petition is as under:- ".....to issue an appropriate writ, order or direction particularly one in the nature of Mandamus declaring the action of the respondents No.1 to 5 herein calling the petitioner to the Asst. Commissioner of Police, Crime Office, Vanasthalipuram, Cyberabad, and asked the petitioner to handover his brother who is alleged to be involved in different crimes, otherwise they would book false cases against the petitioner herein and would subject him to continuous harassment for production of his brother as such the action of respondents are illegal, arbitrary, unreasonable, without jurisdiction and also violative of Articles 14, 21 and 300A of the Constitution of India and issue a consequential direction to the respondents No.1 to 5 herein and not to call the petitioner herein to the Police Station/ Crime Stations and not to threaten him to book false cases and pass such other order or orders.

Learned Government Pleader appearing for respondent Nos.1 to 5 placed on record the written instructions, dated 19.09.2019, issued by the Sub-Inspector of Police, Vanasthalipuram Police Station, Rachakonda Commissionerate.

A perusal of the said instructions would reveal that the allegations made by the petitioner in the affidavit filed in support of the writ petition are absolutely false and the same are denied. In fact,

respondent No.1 to 5 have never called the petitioner to the Police Station and threatened to book false cases against him. The instructions further reveal that the cases registered against the petitioner from 2004 to 2012 have been closed and no case is pending against the petitioner in Vanasthalipuram Police Station. 5.

Taking the above said aspects into consideration, this Court is of the opinion that no further cause would survive in the writ petition. 6.

Accordingly, the writ petition is dismissed.

Miscellaneous petitions pending, if any, shall stand dismissed. No costs.
