HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.32747 of 2015 ORDER:

Heard Sri G. Rajesh, learned counsel appearing for the petitioner and Sri A. Ravi Babu, learned standing counsel for the respondent-Corporation. 2 . The petitioner is a driver in the respondent-Corporation. On 03.04.2010 while he was driving the vehicle bearing No.AP 28 Z 3543 on route Adilabad to Hyderabad, near Race Course Pump, Secunderabad at about 5 a.m., a car suddenly came from right side to left side at high speed and the petitioner applied brakes suddenly, as a result of which, the bus hit the road divider and FOS tyre disc became bent. The driver of the car could not stop the car and ran away. It is the version of the petitioner that he is not at all fault in relation to the accident. However, a charge sheet was issued to the petitioner on the allegation that due to his rash and negligent driving, he caused damage to the bus.

He submitted a detailed explanation. Thereafter, an enquiry was held and the Disciplinary Authority basing on the enquiry report, found the petitioner guilty of misconduct in performing the duties of a driver and imposed punishment by deferring annual increment for a period of two years with cumulative effect vide order dated 06.08.2015. Feeling aggrieved, he preferred an appeal through proper channel to the 2nd respondent on 02.02.2015 seeking to set aside the order dated 06.08.2010. Though the appeal was preferred long back, the 2nd respondent did not hear and dispose of the appeal.

3. In the circumstances, the 2nd respondent is directed to hear and dispose of the appeal dated 02.02.2015 submitted by the petitioner and pass appropriate orders thereon within a period of eight (8) weeks from the date of receipt of a copy of this order.

4. The writ petition is accordingly disposed of at the state of admission.

Miscellaneous petitions, if any, in this writ petition, shall stand closed. No order as to costs.
