THE HON'BLE JUSTICE G.SRI DEVI Tr.CRIMINAL PETITION No.97 of 2019 ORDER:

This Transfer Criminal Petition is filed by the petitioner/accused seeking to transfer C.C.No.726 of 2018 from the Court of the learned VIII Special Magistrate, Kukatpally, Ranga Reddy District, to the Court of X Special Magistrate, Erramanzil, Hyderabad, to be tried along with C.C.No.615 of 2018.

Heard learned counsel for the petitioner, learned Additional Public Prosecutor appearing for respondent No.1-State and perused the record. 3.

Learned counsel for the petitioner submitted that both the aforesaid C.Cs were arising out of one transaction of hand loan and as such, it is desirable that both the said C.Cs are tried by one Court to avoid delay and prayed to allow the petition.

It is brought to the notice of this Court that both the aforesaid C.Cs were filed under Section 138 of the Negotiable Instruments Act and the petitioner herein is the sole accused in the said cases; and that both the cases were said to be arising out of one transaction of hand loan and hence, to avoid multiplicity of litigation and conflicting judgments and for better appreciation of the cases, it is desirable that both the cases are tried and disposed of by one Court.

In the light of the above, the Transfer Criminal Petition is allowed and C.C.No.726 of 2018 is withdrawn from the Court of the learned VIII Special Magistrate, Kukatpally, Ranga Reddy District and transferred to the Court of X Special Magistrate, Erramanzil, Hyderabad, to be tried along with C.C.No.615 of 2018.

Miscellaneous petitions, if any pending in this criminal petition, shall stand dismissed.
