THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 23437 of 2019 O R D E R:

Petitioner asserts that land admeasuring Acs.3.34 guntas in Survey No.496 of Ananthagiri Village, Ellanthakunta Mandal, Rajanna Sircilla District, came to be acquired for the purpose of submergence of Ananthagiri Reservoir under Kaleshwaram Project, Package No.10 pursuant to notification dated 16.08.2018 and an Award was passed on 13.07.2019. She filed this writ petition apprehending that in spite of her objections filed on 11.09.2019, the respondents may disburse the compensation ignoring the pendency of partition suit, being O.S.No.75 of 2019, filed by her in the Court of the Principal Junior Civil Judge, Sircilla, claiming one-fourth of the undivided share on par with respondent Nos.9 to 11. Heard learned counsel for the petitioner and learned Government Pleader for Land Acquisition appearing for respondent Nos.2 to 4.

As can be seen from the material documents filed by the petitioner, a notice, dated 15.07.2019, came to be issued to respondent No.9 intimating that on account of the disputes with respect to the ownership of the above-stated land, the matter has been referred to the Authority notified under Section 64 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (for short 'the Act'), and the compensation amount of Rs.19,90,265/- stands deposited with the Authority.

As the claim of the petitioner stands referred to the Authority notified under Section 64 of the Act, no further orders are required to be passed in the writ petition. However, the Authority notified under Section 64 of the Act shall deal with the objections filed by the petitioner as well as the objections, if any, filed by respondent Nos.9 to 11, in accordance with law.

Subject to the above, the writ petition is disposed of. Miscellaneous petitions, if any, pending in this Writ Petition shall also stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:28.10.2019 kdl
