HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND HON'BLE SRI JUSTICE A. SHANKAR NARAYANA WRIT PETITION No.20665 OF 2008 ORDER: (Per Hon'ble Sri Justice V. Ramasubramanian) The petitioners in this writ petition appeared for EAMCET examination and they claim to have qualified in the entrance examination. But, the respondents refused to allow the petitioners to attend the counselling held on 27-08-2008, on the basis of a Government Order in G.O.Ms. No.144, Rural Welfare Department, dated 17-072008. As per the said Government Order, the certificate issued in Andhra and Rayalaseema Regions were not accepted. Therefore, the petitioners have come up with the above writ petition seeking a mandamus to declare the action of respondent Nos.3, 4 and 5 in not allowing them to participate in the counseling held in 2008 as illegal.

2. While ordering notice in the writ petition, on 2209-2008, this Court issued an interim direction to the 3rd respondent to treat the petitioners as belonging to Scheduled Castes, on the basis of the certificates issued by the respective Mandal Revenue Officers. We do not

know whether pursuant to the said order, the petitioners participated in the counselling, got selected and joined the course.

3. Today a period of eight (08) years have passed. If in compliance with the interim orders the petitioners were treated as belonging to the scheduled castes and permitted to attend the counselling and also granted admission, by now they would have completed the Engineering Degree Course. If they were not permitted, pursuant to the interim orders, there is no point in now allowing them to participate in the counselling after such a long time.

4. In other words, the writ petition has by now become infructuous, in either of the circumstances narrated above. Therefore, writ petition is dismissed. No order as to costs.

Consequently, miscellaneous petitions, if any, pending in this writ petition, shall stand closed. __________________________ V.
