THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION NO. 5632 OF 2015 ORDER:

Heard the learned counsel for the petitioner as well as the learned GP appearing for respondent Nos. 1 to 5. 2.

The prayer sought in the Writ Petition is as under: " ....to issue a writ, order or direction and more particularly one in the nature of Writ of Mandamus directing the Respondents to consider the request of the Petitioner-Samithi to release Rs.20 crores from the Central Special Budget before the close of the current financial year."

During the course of hearing, learned GP placed on record, the letter No.C1/ 1712/ 2015 dated 25.11.2018 addressed by the District Collector, Nalgonda to the GP for Social Welfare. In the said letter, it is mentioned as under:

" It is to further inform that since the writ petitioner is requested to release Rs.20.00 Crores to the society which is established by him under his president ship, no budged related to the Central Government is available with the District Collector. Further there is no provision to release of such a huge amount in favour of a society established by a private person by the District Collector. All government funds related to the benefit of poor SC, ST families will be released through SC Corporation, MADA etc., duly following the guidelines and eligibility. Further, since the writ petitioner belong to Suryapet District, during the bifurcation and creation of new Districts, entire file has been transferred to Suryapet District. On verification of the scanned record, it is revealed that the letter received from the SC/ ST commission has been sent to the Dy. Director (Soc ial Welfare), Nalgonda for submitting detailed report. The SC Development Officer, Nalgonda has been requested to furnish the action taken report in the matter."

In the light of the said letter, it is for the Government to consider for releasing the amount for the benefit of the poor SC/ ST families through SC Corporation, MADA etc., duly following the

guidelines and the eligibility criteria. As such, there are no merits in the Writ Petition.

Accordingly, the Writ Petition is dismissed.

It is needless to observe that the petitioner is given liberty to make a representation before the appropriate authority to seek redressal of his grievance.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
