HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO W.P.No.30613 of 2017

ORDER

It is the case of the petitioner that an extent of Ac.0-20 cents of land in Sy.No.59/10 of Charla Village including RCC building bearing Door No.8-422 belongs to her grandmother and her grand mother executed a registered will in her favour on 25.08.1987. Thereafter, her grandmother died in the year 1995. Since then, she continued to be in possession of the said house. While so, respondents 4 and 5 highhandedly demolished the said house and trying to construct a house without obtaining any permission from the 3rd respondent. Hence, she submitted a representation on 19.07.2017 to the 3rd respondent seeking action against respondents 4 and 5. But no action has been taken thereon so far. Hence, the petitioner filed the present writ petition stating that she has no alternative remedy except to approach this Court. She further states that one late Chitturi Srinivasa Rao, is her brother, the 4th respondent is his wife and 5th respondent is their son. She also states that it is the duty of the 3rd respondent to verify as to whether any permission is obtained

from the Gramapanchayat by respondents 4 and 5 for construction of the said building.

The above averments clearly show that there are some property disputes between the petitioner and the 4th respondent. The petitioner has not filed any document seeking information with regard to obtaining permission from the Gramapanchayat by respondents 4 and 5. The petitioner also did not state as to what action was taken when the said RCC building was demolished by respondents 4 and 5. Hence, this Court is not inclined to entertain the present writ petition as the petitioner has an alternative remedy to approach the competent Court. Accordingly, the writ petition is dismissed. No costs. Miscellaneous petitions, if any, pending shall stand closed. ___________________________________ JUSTICE A.RAMALINGESWARA RAO 11th September, 2017 rkk Note: Issue CC by two days.
