HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.21781 of 2017 ORDER:

Heard Mr. A. Prabhakar Rao for petitioner and the Assistant Government Pleader (Revenue) for respondents.

2. As directed by this court on 04.07.2011 the Tahsildar has filed counter-affidavit and in the counter-affidavit, he has specifically referred to a few of the allegations made against the Tahsildar, when he inspected the drilling of the bore well, seizure and subsequent release after fine was imposed on the drilling bore well.

3. Mr. Prabhakar Rao, taking note of the conditions, through which permission is granted and also scheme of the Act, requests the court to permit the petitioner to apply for permission to drill a bore well of 61⁄2" and the Tahsildar may be directed to consider and pass orders uninfluenced by the happenings and also according to law. The Assistant Government Pleader does not object to the request and submits that the application of petitioner will be considered and orders passed expeditiously.

4. The writ petition is, accordingly, disposed of. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
