HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8617 of 2015 ORDER:

This petition is filed by the petitioners-accused seeking to relax the conditions imposed by the Special Magistrate, Nandyal while granting bail vide order dated 31.7.2015 in Crl.M.P.No.2559 of 2015 in C.C.No.502 of 2014.

The 1st petitioner is the company. The 2nd petitioner is the Managing Director of the 1st petitioner-company. He filed the above Crl.M.P., before the Court below seeking to enlarge him on bail. The Court below while granting bail to the 2nd petitioner imposed condition directing him to furnish two local sureties of Nandyal for the cheque amount. Seeking to relax the above condition, the petitioners filed this petition.

Heard and perused the material available on record. Considering the facts and circumstances of the case, this Court is inclined to pass the following order:

"The 2nd petitioner is directed to execute a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for the like sum each to the satisfaction of the Court concerned, instead of furnishing two local sureties."
