HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION NO.3432 OF 2016 ORDER:

This petition is filed by the petitioner-A4 aggrieved over the order dated 24.2.2016 passed by the Principal Sessions Judge, Nellore, on the memo filed by the petitioner in Crime No.119 of 2008. Earlier, the petitioner approached this Court seeking to relax the conditions imposed by the learned Sessions Judge, Nellore while granting bail to her vide order dated 4.3.2014 in Crl.M.P.No.269 of 2014. This Court relaxed the condition imposed by the learned Sessions Judge with regard to the petitioner leaving India without permission of the Court, while directing the petitioner to file an affidavit before the Court concerned informing the dates of her travel. This Court has also ordered to return the passport of the petitioner on condition of her executing a personal bond for a sum of Rs.50,00,000/- with one surety for the like sum.

Subsequently, the said surety amount is reduced to Rs.10,00,000/-. The petitioner approached the learned Principal Sessions Judge by filing a memo stating that she was permitted by this Court to take her passport on execution of a personal bond for a sum of Rs.10 lakhs with one surety for the like sum and on filing an affidavit before the learned Sessions Judge stating the dates of her travel.

(1) Copy of order in Crl.M.P.No.10630 of 2015 dated 12.10.2015 of the Hon'ble High Court of A.P. to be filed. (2) Copy of order in Crl.M.P.No.13468 of 2015 dated 18.12.2015 on the file of the High Court of A.P. to be filed;

(3) Correct affidavit of the petitioner to be filed as per the orders of the High Court in Crl.P.No.7929 of 2015;

(4) One surety belonging to A.P. to be filed as per the condition

No.3 of the High Court of A.P. in Crl.P.No.7929 of 2015. In the circumstances of the case, the learned Principal Sessions Judge, Nellore, is hereby directed to return the passport of the petitioner herein without insisting for compliance of the above direction Nos.1 and 2 on the memo filed by the petitioner. However, it is made clear that insofar as directions Nos.3 and 4 on the memo filed by the petitioner before the learned Sessions Judge are concerned, the petitioner is directed to furnish surety belonging to the State of Andhra Pradesh and to file affidavit.

Accordingly, the Criminal Petition is disposed of.

Consequently, miscellaneous petitions pending, if any, shall stand closed.
