HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION NO.4275 OF 2017 ORDER:

After hearing the learned counsel for the petitioner and when the matter was about to hear on the prosecution side, learned Public Prosecutor would submit that having regard to the magnitude of the offence, bail may not be granted at this stage where the prosecution has already filed the charge sheet, which was returned by the trail Court and the same is in the process of resubmission. Thus, having regard to the stage, learned Public Prosecutor opposed the bail. He would fairly submit that since the segregation of different items of the property is under way, the I.O. may take about one month time to complete that exercise to resubmit the charge sheet.

In view of the above submission, without going into the merits of the case, this bail application is dismissed with a direction to the prosecution to submit charge sheet before the concerned court within one month from today and with a liberty to the petitioner/ accused to move the bail application after resubmission of the charge sheet. It is needless to mention that even in the event of prosecution failing to resubmit the charge sheet within the stipulated time, the petitioner/ accused will be at liberty to file the bail application for consideration.
