HON'BLE SRI JUSTICE S.V. BHATT W.P.No.18133 OF 2013 ORDER:

The petitioner prays for the following relief: ...to issue a Writ or Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the 1st respondent in directing the petitioner to settle the matter with respondents 3, 4 and 5 and threatening the petitioner to withdraw CRP.No.1530 of 2013 on the file of the Hon'ble High Court of Andhra Pradesh as illegal, arbitrary, without jurisdiction and in violation of Article 21 of the Constitution of India and further direct the 1st respondent not to send for the petitioner to the 1st respondent-police station or any other place and not to interfere in the civil dispute between the petitioner and that of the respondents 3, 4 and 5 and also not to register any criminal case in respect the said dispute between the petitioner and that of the respondents 3, 4 and 5 and pass ..........."

The stand of 1st respondent in the counter affidavit is as follows:

"It is pertinent to submit that as of now, no complaint whatsoever is received or registered against the petitioner herein on the file of Alwal Police Station. It is respectfully submitted that this respondent never sent any of the constables of the police station to summon the petitioner and asked her to settle the matter with the unofficial respondents herein. It is also submitted that this respondent never threatened the petitioner nor asked her to withdraw the CRP.No.344 of 2011 on the file of this Hon'ble Court. I humbly submit that to prevent the police from taking any action in the event of lodging of any complaint against her, the petitioner rushed to this Hon'ble Court and filed the present writ petition with baseless allegations. It is humbly submitted that the dispute of the petitioner as well as the unofficial respondents herein is purely civil in nature and this respondent has no way concerned with it. I humbly submit that this respondent

never interfered with the civil disputes much less the dispute of the petitioner herein..."

This Court is of the view that no case is made. By placing on record the stand of respondent in the counter affidavit, the writ petition is disposed of. There shall be no order as to costs. Consequently, pending miscellaneous petitions, stand closed. ____________ S.V.BHATT, J 08th November 2017 Lrkm
