THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.2779 OF 2008 ORDER:
This writ petition is filed challenging the award dated 28.12.2006 passed in ID.No.163/2003 by the Chairman-cumPresiding Officer, Industrial Tribunal-cum-Labour Court, Anantapur wherein relief was granted in favour of 1st respondent herein. When the writ petition came up for hearing on 24.06.2011, this Court passed the following order;
"Learned counsel for the petitioner is permitted to take out personal notice to respondent No.1 by registered post with acknowledgment due and file proof of service within a period of 02 (two) weeks, in default, the writ petition shall stand dismissed as against respondent No.1 without further reference to the Court"
By virtue of the aforesaid order, the writ petition was dismissed for default against the 1st respondent as proof of service of notice is not filed within the time stipulated. When the writ petition is dismissed against the 1st respondent for default, no relief can be granted to the petitioner.
Accordingly, the writ petition is dismissed. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
