THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.91 of 2016 ORDER:

This Criminal Petition is filed by the petitioner-A.1 under Section 482 Cr.P.C., to quash the proceedings in C.C.No.787 of 2015 pending on the file of VIII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad. Heard.

The case was filed by the District Inspector, Legal Metrology, Weights & Measures, HQ-II, Hyderabad for the offence under Section 32 of the Legal Metrology (Enf.) Rules, 2011 r/w Rule 6(1)(e) of the Legal Metrology (PC) Rules, 2011.

Similar issue fell for consideration before this Court in Crl.P.No.1393 of 2007 and this court by judgment dated 03.04.2007 allowed the said Criminal Petition quashing the impugned proceedings therein. Following the judgment dated 03.04.2007 in Crl.P.No.1393 of 2007 and for the reasons stated therein, this Criminal Petition is allowed and the proceedings in C.C.No.787 of 2015 pending on the file of VIII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad are hereby quashed as against the petitioner herein.

Miscellaneous Petitions filed in this Criminal Petition, if any, shall stand closed.
