When this matter is taken up for hearing, learned counsel for the 1st respondent had informed to this Court that the 1st respondentworkman had expired on 6.5.2010 and he had informed to the learned counsel for the petitioner vide his letter dated 3.8.2010 that the 1st respondent had expired. and he had also contacted the legal representatives of the deceased workman.

Though the letter is served by the learned counsel for the 1st respondent on the counsel for the petitioner on 3.8.2010 itself, learned counsel for the petitioner has not taken any steps to bring the legal representatives on record.

In view of the above, the Writ Petition is dismissed as abated. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
