HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.22478 OF 2017 O R D E R :

The case of the petitioner is that he is having land to an extent of Ac.2.34 cents in Survey No.35/3, and Ac.0.06 cents in Survey No.33/2C, situated at 115-Settypalle Village, Gudipalle Mandal, Chittoor District and that the said lands are ancestral property of the petitioner. The 6th respondent issued pattadar pass books and title deeds vide Khata No.54 in favour of the petitioner and that the revenue authorities also issued latest Adangals and 1B registers in favour of the petitioner. The petitioner is a small farmer and cultivating the said lands without any disturbance whatsoever. While so, the respondents 3 to 8 without issuing any notice to the petitioner and without following due procedure entered into the petitioner's land and started marking the lands for the purpose of laying road through the petitioner's lands. Aggrieved by the same present writ petition is filed. Heard learned counsel for the petitioner.

Learned Assistant Government Pleader for Roads and Buildings submits that the respondent authorities will follow due process of law before taking any action against the petitioner's lands.

Recording the aforesaid submission of the learned counsel, the writ petition is disposed of directing the respondent authorities not to lay road through the petitioner's private lands, without following due process of law. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any pending in the writ petition, shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 07.07.2017 t k.
