HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.32318 of 2016 ORDER:

The case of the petitioner is that she is in peaceful possession and enjoyment of land to an extent of Ac.2-20 guntas in Sy.No.322/3 of Dhamslapuram Village, Khammam Urban Mandal and Khammam District by virtue of assignment on 19-07-1979. However the petitioner's assignment was cancelled and as such, she filed appeal before the 3rd respondent and on 02-09-2016 the appellate authority dismissed the appeal confirming the order of the 4th respondent. The petitioner has filed further appeal before the 2nd respondent on 08-09-2016 along with stay petition. But no orders are passed in the stay petition/appeal. Meanwhile, the 4th respondent has issued memo in Rc.No.B/17896/2007, dated 06-09-2016 stating that subject land is allotted to the Housing Scheme.

Heard learned counsel for the petitioner.

Learned Assistant Government Pleader for Revenue says that the possession was taken in the year 2008. The order dated 19-11-2013 passed by this Court in WP.No.32994 of 2013 filed by the petitioner goes to show that a direction was given not to dispossess the petitioner till the appeal filed by her before the 3rd respondent is disposed of. Now the impugned memo is passed. Since the statutory appeal is pending before the 2nd respondent, the 2nd respondent is

directed to dispose of the same, in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. Till then, interim stay of dispossession of the petitioner, since already interim order is subsisting in favour of the petitioner as per orders in WP.No.32994 of 2013. Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
