THE HON'BLE DR JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.6004 OF 2017 ORDER:

Heard the learned counsel for the petitioners-accused Nos.1 to 7 and the learned Public Prosecutor for the State. Perused the record.

This Criminal Petition is filed to quash the proceedings in CC.No.173 of 2017 on the file of the Special Judge for Economic Offences-cum-VIII Additional Metropolitan Sessions Judge, Nampally, Hyderabad.

Having argued for some time, learned counsel for the petitioners submitted that the petitioners are aged persons and some of them are above 70 years old; if their personal appearance before the trial Court is dispensed with, that would be sufficient; and, as and when their appearance is required by the trial Court, they are ready to appear.

In view of the age of the petitioners and since the allegation against them is only of non-submission of cost audit report within stipulated time, the prayer of the petitioners can be considered. In the result, the petitioners-accused Nos.1 to 7 are permitted to file appropriate application before the trial Court. On filing such application, the trial Court shall consider the same.
