THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37273 of 2016 ORDER:
This writ petition is filed seeking to declare the inaction of the 3rd respondent in proceeding with the investigation in Crime No.217 of 2015 as illegal and arbitrary.
Heard and perused the material available on record. The case of the petitioner is that the petitioner is the de facto complainant who lodged a private complaint against the 4th respondent before the Judicial Magistrate of First Class, Kothagudem and the same was referred to the 3rd respondent and the 3rd respondent registered the case as Crime No.217 of 2015. The main grievance of the petitioner is that even though the said crime was registered on 05.09.2015, till date, the 3rd respondent has not completed the investigation and filed the charge sheet.
Learned counsel for the respondents submitted that the respondent police are proceeding with the investigation and they are likely to file charge sheet after completion of the investigation. Considering the said facts and circumstances, the 3rd respondent is directed to complete the investigation in Crime No.217 of 2015 as expeditiously as possible and file a final report, if any, either way in accordance with law.
Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 1st November, 2016 KL
