THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.1785 of 2008 ORDER:

This Writ Petition is filed seeking the relief as under: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue a writ or order or direction, one in the nature of writ of mandamus, i) Declaring the action of the 4th respondent in not publishing the valid member voters list and not holding election to the petitioner society as per the schedule fixed by the 2nd respondent as arbitrary, illegal, unreasonable and violative of Article 14 of Constitution of India and contrary to the provisions of the A.P.C.S.Act and Rules made there under and consequently direct the respondents to hold the elections to the petitioner society as per the schedule fixed by the 2nd respondent vide R.C.No.1/2008, dt.04.01.2008.

ii) Costs be awarded and pass such other order(s) as this Hon'ble Court may deem fit in the circumstances of the case, in the interest of justice."

Inasmuch as the relief claimed is in relation to the elections, which were scheduled on 04.01.2008, nothing survives in the Writ Petition at this point of time.

Accordingly, the Writ Petition is dismissed as infructuous. Miscellaneous Petitions, if any pending in this Writ Petition shall stand closed. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J
