Sri Yogesh Kumar Heroor, Advocate representing Sri Vijay Kumar Heroor, advocate for appellants requested time on the ground counsel is out of Country. This matter is posted from 07.11.2015 only on the request of advocate for appellants with a direction that no further adjournment will be granted. In spite of that, no alternative arrangements are made to proceed with the case. Second Appeal is of the year 2005, and no interest is evinced to proceed with the matter and it is still at the stage of admission. Considering these aspects, I am not inclined to further adjourn the case.

In view of the same, this second appeal is dismissed for nonprosecution. No costs. Miscellaneous Petitions pending in this appeal, if any, shall stand closed.
