THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.33240 OF 2010 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue an order or direction or writ specially Writ of Mandamus be pleased to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus: (a) declaring the action of the respondents 5 to 8 in seizing the vehicles bearing registration No.AP 01 X 2408 and AP 01 X 2409 carrying Manganese ore in spite of possessing valid transport permits on 16.10.2010 as illegal, arbitrary; and (b) direct the respondents 5 to 9 to forthwith release the vehicles bearing No.AP 01 X 2408 and AP 01 X 2409 along with the Manganese Ore in favour of the petitioner; and (c) direct the respondents to pay a compensation of Rs.30,00,000/- towards expenditure incurred for prospecting, demurrage charges for the vehicles and towards mental trauma and (d) direct the 1st respondent to initiate appropriate disciplinary proceedings against the respondents 6 and 8." 2.

Heard and perused the material available on record. 3.

On 29.12.2010, this Court passed an interim order in W.P.M.P.No.42179 of 2010 directing the respondents to release the vehicles of the petitioner bearing Nos.AP 01 X 2408 and AP 01 X 2409. Learned counsel for the petitioner submitted that in pursuance of the said order, the vehicles of the petitioner were already released.

Considering the facts and circumstances of the case, the interim order passed by this Court on 29.12.2010 in W.P.M.P.No.42179 of 2010 is made absolute and the Writ Petition is disposed of. There shall be no order as to costs. 5.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
