THE HON'BLE SRI JUSTICE R. KANTHA RAO CONTEMPT CASE No. 1864 of 2015 ORDER:- In a writ of Mandamus for issuance of a direction to the respondents to extend the benefit of pension scheme to the petitioners with effect from 01.10.2014 and pay the arrears of pension along with interest, this Court issued an interim direction directing the respondents to consider the representations dated 29.04.2015 and 14.07.2015 submitted by the petitioners and pass appropriate orders within a period of four weeks.

2. The respondents issued proceedings dated 19.11.2015 stating that the representation of the petitioners was considered in the light of the interim order passed by this Court and their claim was rejected on the ground that they retired from service long back and they received the retiral benefits soon after their retirement and therefore there is no relationship of employer and employee between the petitioners and the respondents.

3. Since the said proceedings were issued after considering the representations submitted by the petitioners, no cause survives for adjudication in the contempt case. The petitioners can, however, agitate the issue in the writ petition filed by them and challenge the proceedings dated 19.11.2015 in the said writ petition.

Contempt Case is, accordingly, closed. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
