THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2680 of 2016 ORDER:

This Criminal Petition is filed by A.1 to A.5 under Section 482 Cr.P.C., to quash the proceedings in C.C.No.377 of 2011 pending on the file of XIII Additional Chief Metropolitan Magistrate, Hyderabad for the offences under Section 498-A IPC and Sections 4 & 6 of Dowry Prohibition Act. Heard.

The grounds now raised by the learned counsel for the petitioners for quashing the impugned proceedings are all disputed questions of facts which can be adjudicated by the trial Court only after full-fledged trial. Hence, this Court is not inclined to interfere with the impugned proceedings. At this stage, the learned counsel for the petitioners confined his argument to the extent of dispensing with the presence of the accused-petitioner Nos.1,2, 4 & 5 before the trial Court.

In the circumstances, except petitioner No.3-A.3 i.e. Gopireddy Obul Reddy, S/o.late Narapa Reddy, the presence of other petitioners hereinA.1,A.2, A.4 & A.5 before the trial Court is dispensed with except on the dates so specifically the trial Court insists for their appearance. They are directed to be represented by petitioner No.3-A.3 on all hearing dates. Accordingly, the Criminal Petition is disposed of. Miscellaneous Petitions filed in this Criminal Petition, if any, shall stand closed.
