THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.13935 of 2015 ORDER:
This petition is filed under Section 482 Cr.P.C. to quash the proceedings against the petitioners/accused Nos.1 to 3 in C.C.No.354 of 2011 on the file of the Judicial Magistrate of First Class, Vemulawada, Karimnagar District.
At the time of arguments, learned counsel for the petitioners submitted that the concerned Magistrate may be directed to dispose of the matter as early as possible. He further submitted that the petitioners 2 and 3/A2 and A3 are facing much inconvenience to attend the Court on each and every date of adjournment, hence, their presence before the trial Court may be dispensed with.
Having regard to the facts and circumstances of the case and also in view of the submission made by the learned counsel for the petitioners, the learned Judicial Magistrate of First Class, Vemulawada, Karimnagar District, is hereby directed to dispose of C.C.No.354 of 2011 as expeditiously as possible, preferably, within a period of six months from the date of receipt of copy of this order. The presence of petitioners 2 and 3/A2 and A3 before the Court of Judicial Magistrate of First Class, Vemulawada, Karimnagar District, is hereby dispensed with on each and every date of adjournment. However, they shall appear before the trial Court as and when their presence is so required. With the above direction, the Criminal Petition is dismissed. Consequently, Miscellaneous Petitions, if any, pending in
this Criminal Petition shall stand closed.
